1. Acceptance of Terms 

These Terms of Service ("Terms") constitute a legally binding agreement made between you ("User," "you," or "your") and OptOutScout LLC ("OptOutScout," "we," "us," or "our"), located in Boise, Idaho. These Terms govern your access to and use of the OptOutScout website and our automated personal data removal platform (collectively, the "Service"). By creating an account or subscribing to the Service, you expressly agree to be bound by these Terms. If you do not agree to all of the provisions herein, you are expressly prohibited from using the Service.

2. The Service and Authorized Agent Designation 

OptOutScout provides an automated software platform designed to locate and submit removal, suppression, and opt-out requests regarding your personal information to third-party data brokers, aggregators, and people-search databases.

Limited Power of Attorney / Authorized Agent Mandate: 

By subscribing to the Service, you explicitly designate and appoint OptOutScout LLC as your legally Authorized Agent to exercise your privacy rights under applicable U.S. state and federal laws, including but not limited to the California Consumer Privacy Act (CCPA/CPRA), the Texas Data Privacy and Security Act (TXDPA), the Virginia Consumer Data Protection Act (VCDPA), and other applicable comprehensive state privacy frameworks.

You explicitly grant OptOutScout the authority to:

• Generate, electronically sign, and submit legally binding data deletion, opt-out, and suppression requests on your behalf.

• Communicate with third-party data brokers, compliance officers, and legal departments for the sole purpose of confirming the removal of your records.

• Utilize the personal identifiers you provide to us strictly to locate and suppress your profiles within third-party databases.

This Authorized Agent designation remains in effect solely for the duration of your active subscription and terminates immediately upon account cancellation.

3. Subscription, Billing, and Auto-Renewal

• Annual Fee: The Service is provided as an annual subscription billed at $19.99 per year.

• Automatic Renewal: To ensure continuous protection against data repopulation, your subscription will automatically renew every twelve (12) months from the date of your initial signup. Your authorized payment method will be charged the applicable annual fee unless you cancel your subscription prior to the renewal date.

• Scan Frequency: While your subscription remains active, OptOutScout will execute a comprehensive "Scout & Remove" cycle for your data every one hundred and twenty (120) days (equating to three full automated sweeps per year).

4. Your Responsibilities and Representations 

By utilizing the Service, you represent and warrant that:

• Eligibility & Geography: You are at least eighteen (18) years of age and are a current or recent resident of the United States. Our Service is not designed for and does not operate for residents outside of the United States.

• Data Ownership & Permission: You agree not to abuse our Service. You will provide only your own personal information, or the personal information of another adult who has provided you with explicit, verifiable permission to sign up on their behalf.

• No Minors: You will not enter personal information for anyone currently under the age of eighteen (18).

• Prohibition of Sensitive Data: You agree not to provide OptOutScout with highly sensitive identifiers, including Social Security Numbers (SSNs), passwords, or government-issued photo identification. We do not require this information to execute our Service.

5. Limitations of Service and Liabilities 

While OptOutScout utilizes advanced automation and legal leverage to suppress your digital footprint, you acknowledge and agree to the following operational limitations:

• No Guarantees: We will execute our Service to the highest possible standard, but we make no absolute guarantees of absolute removal from the entire internet. We cannot remove data from government-hosted public records, news publications, or social media platforms.

• Dynamic Coverage: The specific data brokers and people-search sites we support will change over time as the industry evolves, websites shut down, or new aggregators emerge.

• Data Broker Actions: As part of the opt-out process, the identifiers you provide to us must be transmitted to third-party data broker websites. OptOutScout is not liable or responsible for how these third-party entities handle, process, or store the data we transmit to them during the execution of a removal request.

• Broker Pushback: Certain data brokers may refuse to honor legal deletion requests without an SSN or unredacted government ID. OptOutScout will refuse to provide these sensitive documents, and you acknowledge that your data may remain on those specific platforms.

6. Cancellation and Data Purge 

You may cancel your subscription at any time via your secure customer billing portal or by emailing support@optoutscout.com. Upon cancellation, your Authorized Agent designation is revoked, and your active Personally Identifiable Information (PII) will be permanently purged from our operational production systems within forty-eight (48) hours, in accordance with our Privacy Policy.

7. Refund Policy 

All refund requests are governed by our official 180-Day Satisfaction Guarantee. Please refer to our Refund Policy for specific eligibility requirements and procedures.

8. Disclaimer of Warranties and Limitation of Liability 

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OPTOUTSCOUT LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OPTOUTSCOUT LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO OPTOUTSCOUT LLC FOR THE SERVICE DURING THE TWELVE (12) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

9. Indemnification 

You agree to defend, indemnify, and hold OptOutScout LLC harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) a breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; or (4) your violation of the rights of a third party.

10. Dispute Resolution, Binding Arbitration, and Class Action Waiver 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Initial Dispute Resolution: We are committed to resolving issues amicably. Before initiating any formal legal proceeding, you agree to contact us at legal@optoutscout.com with a description of the dispute. We agree to negotiate in good faith for no less than thirty (30) days.

• Binding Arbitration: If the dispute cannot be resolved informally, you and OptOutScout LLC agree that any claims, disputes, or controversies arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Ada County, Boise, Idaho, or via video conferencing if mutually agreed upon.

• Small Claims Exception: Notwithstanding the above, either you or OptOutScout LLC may choose to assert claims in a small claims court located in Ada County, Idaho, provided the claims qualify for small claims jurisdiction and proceed on an individual basis.

• Class Action Waiver: YOU AND OPTOUTSCOUT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
